Terms & Conditions

These Terms and Conditions govern the contractual relationship between Beyond Journeys (referred to herein as “the Company,” “we,” or “us”) and the Client (referred to herein as “you,” or “the traveller”) concerning the booking and participation in any tour, including the “Darjeeling Toy Train” experience.

By booking a trip with us, you acknowledge that you have read, understood, and agreed to be bound by these Terms and Conditions.

Confirmation of Booking
A booking is considered confirmed only upon: a. Receipt of the required non-refundable initial deposit (as specified on the specific tour page). b. Written confirmation of the booking issued by the Company.

Deposit and Final Payment
The final balance of the Total Tour Cost must be paid no later than 60 days prior to the scheduled Tour Start Date. Bookings made within 60 days of the Tour Start Date require full payment immediately upon confirmation.

Failure to Pay
If the final payment is not received by the due date, the Company reserves the right to treat the booking as cancelled by the Client, resulting in the forfeiture of the initial deposit.

Pricing
All prices are quoted in the currency specified on the tour page (typically INR). The Company reserves the right to increase or decrease the prices due to changes in government taxes, fuel costs, currency fluctuations, or operational costs.

Services as Agent
Beyond Journeys acts only as an agent for the transportation companies, hotels, and other suppliers of services. We assume no responsibility for any loss, injury, damage, or delay due to any act, omission, neglect, or default of any such person or company, or by any event occurring beyond our control.

Force Majeure
The Company shall not be deemed to be in breach of these terms and conditions or otherwise liable to the Client, by reason of delay in performance, or by non-performance of any of its obligations hereunder, to the extent that any such delay or non-performance is due to any Force Majeure event, which includes war, terrorism, civil unrest, political instability, extreme weather events, natural disasters, epidemics, or government intervention (including but not limited to the closure of the Darjeeling Himalayan Railway).

Governing Law
These Terms and Conditions shall be governed by and construed in accordance with the laws of India. Any legal dispute arising from this agreement shall be subject to the exclusive jurisdiction of the courts in Siliguri, West Bengal, India.
